General Privacy Policy for Website Visitors and Business Contacts

1. Introduction
Advanced Drainage Systems, Inc. ("ADS," "we," "us," or "our") is a manufacturer of world-class water management and drainage products that we sell to enterprise customers. As such, we process only limited types of personal information, personal data, or personally identifiable information (collectively, "PI") about our customers' personnel and visitors to our Online Services (defined below), including job applicants. The purpose of this Privacy Policy ("Policy") is to inform you about the types of PI that we may collect and process when you visit our website or transact business with us. Please note that not all of the PI referenced in this Policy may be collected about you or used for the purposes set out below.
Please note that this Policy applies only to PI collected through our website and emails (“Online Services”) and not to information collected offline except to the extent we combine it with PI collected via our Online Services. We may create deidentified or aggregate data from PI (“Non-PI”) and this Policy does not govern Non-PI, which data we may collect, use and disclose without limitation except as otherwise restricted by applicable law. Our Online Services are operated in the United States and by visiting them you accept the associated collection of your PI in the U.S. and its processing in the U.S. and elsewhere.
2. What information do we collect?
For visitors to our publicly-available website, we collect PI from you when you browse or register on our website, place an order through PipeOrder.com, download and register on our mobile applications ("ADS Installation Guides," "ADS Agricultural Drainage Resource," and "ADS SiteAssist by StormTech"), enter your PI through the "Contact Us" portal, or request a lunch and learn session. We also collect certain information about your session when you visit our website, including internet protocol (IP) addresses, browser type, internet service provider, referring/exit pages, operating system, date/time stamp, and clickstream data. When registering or requesting to be contacted via our Online Services, you may be asked to enter your name, e-mail address, mailing address and/or phone number.
We may also collect PI (e.g., name, title, contact details, etc.) when we interact with you in relation to the negotiation or fulfillment of our contracts with you if you are an ADS customer or one of our suppliers.

3. What do we use Online Services visitors' information, business contact data, and job applicant information for?
We collect and process the PI collected via our Online Services for the following purposes:
Online Services Visitor PI:
- To personalize your experience (your information helps us to better respond to your individual requests);
- To improve our website (we continually strive to improve our website offerings based on the information and feedback we receive from you);
- To improve customer service (your information helps us to more effectively respond to your customer requests and support needs);
- To process transactions;
- To administer a contest, promotion, survey or other website feature;
- To market our products and services;
- To send periodic emails (the email address you provide may be used to send you information, respond to inquiries, and/or other requests or questions); and
- For other purposes in the operation of our business not inconsistent with this Policy or applicable law.
Business Contact PI:
To communicate with you during contract negotiations or post-contract support;
- To market to you, including to advise you of additional or new products and services that may be of interest to your company; and
- For other purposes in the operation of our business not inconsistent with this Policy or applicable law.
Applicant PI:
- To evaluate your credentials and candidacy when applying for a position with ADS; and
- For other purposes in the operation of our business not inconsistent with this Policy or applicable law.
4. How do we protect your PI?
We implement a variety of security measures to maintain the safety of your PI when you place an order through PipeOrder.com, or enter, submit, or access your PI. These precautions may include password protections for online information systems, such as PipeOrder.com, and restricted access to PI. ADS takes reasonable and appropriate measures to secure your PI.
Our publicly available website is hosted on a secure server.
5. Do we use cookies?
When you visit our website or mobile apps, utilize our online services, open an email that we send you, or interact with the communication features on our Online Services, we and third parties may collect information about your usage or device by automated means or by using tracking technologies such as cookies, web server logs, and web beacons (Tracking Technologies”). Some of the Tracking Technologies we or third parties may use to collect information automatically collected include:
- Cookies: Cookies are small text files that websites send to your computer or other Internet connected device to uniquely identify your browser or to store information or settings in your browser. We may use cookies that are managed by ADS or by third parties for the purposes provided in this Policy, including for session management, authentication, user preference storage, Systems performance and personalization, Systems analytics, advertising (including affiliate marketing), content management, search, and social media integration.
- Web server logs: In conjunction with obtaining information through cookies, our web servers may log details regarding your device, operating system, or information about your usage of our website.
- Web beacons and pixels: We may place tags on our website or in emails called "web beacons" or "pixels." These are computer instructions that link web pages to particular web servers and their cookies. Web beacons and pixels can be used to track the pages you view, links that you click, or other online behavior. These tools have a number of uses, such as measuring the effectiveness of our email campaigns and online advertisements (both on our website and on third-party websites).
- Other: In addition to cookies, web server logs, and web beacons, we may use other technologies to collect information for the purposes described in this Policy.
These Tracking Technologies may permit the collection of information such as demographic data, browser type, MAC address and other device information, operating system type and settings, domain, the address of the web page that linked you to our website, IP address, pages visited, whether you have visited us before or are new to the website, activities conducted on the page (such as search queries), and the day and time of your visit.
We and/or third parties may use Tracking Technologies associated with our Online Services to collect PI about you and your interactions with social media and other third-party websites and online services over time, which we may merge or enhance with other information we collect about you for the purposes described above in this Policy. In addition, we may supplement PI we collect via our Online Services with other information, including offline data from third parties, for marketing and other purposes, in which case we will treat the combined data as PI under this Policy.
At this time, we do not honor "do not track" signals from website browsers. However, you may refuse or delete cookies. If you do so, some of the functionality of our website may be impaired. Additionally, you may still be identifiable and your usage may still be trackable by other means. Please refer to your browser "Help" instructions to learn more about how to manage cookies and the use of similar technologies.
6. Do we disclose any information to outside parties?
We do not sell, trade, or otherwise transfer PI to outside parties unrelated to the operation of our business.
However, we do share PI with service providers we have retained to perform certain services and functions on ADS's behalf in connection with their performance of the services for us subject to appropriate use and nondisclosure limitations.
Other instances when we may disclose any PI to outside parties include:
- When we reasonably believe that such disclosure is required by law or pursuant to legal process, or is necessary in connection with actual or threatened litigation or to protect ADS or third parties.
- When we agree to sell, transfer or merge all or a portion of our business or assets, in which case ADS will endeavor to ensure that the transferee agrees to use the PI in a manner consistent with this Privacy Notice.
7. How Long Do We Retain Your Information?
We will keep the PI that is subject to this Policy for as long as is reasonably necessary to achieve the purpose for which you provided it, or to the extent necessary for ADS to protect its rights, or as required by applicable laws.
8. Collection of PI from Children
Our Online Services are intended for individuals 18 years of age and older. It is not directed at, marketed to, nor intended for children under 18 years of age. ADS does not knowingly collect any information, including PI, from children under 18 years of age via our Online Services. If you believe that we have inadvertently collected PI from a child under the age of 18, please contact us at the email address below, and we will take immediate steps to delete or otherwise treat the data as required by applicable law.
9. Changes to our Privacy Policy
ADS conducts an annual self-assessment in order to verify that this Policy is accurate, published, and implemented within ADS. If we decide to change our Policy, we will post those changes on this page, and update the Policy modification date above, and the Policy posted at the time of your visit will govern the PI collected during that visit. This Policy may be supplemented by additional notices at the time of collection.
